Burk Law Firm, P.C. as a business and commercial trial firm takes a minimalist approach to discovery and cost management in lawsuits. Whether the Firm handles the case on an hourly fee basis, a hybrid basis (substantially reduced hourly with a back end percentage interest with credit for fees paid, etc.), a full contingent fee arrangement, or on a flat fee basis, our approach is to do only the discovery that is critical to preparing the case for trial which is also the best way to place the case in the best posture for pretrial settlement.

Whistleblower/Qui Tam, Contingent Fee

At The Burk Law Firm, P.C. (the “Firm,” or “BLF”) we prosecute whistleblower and qui tam litigation on a full contingent fee basis. The Client, the whistleblower/qui tam relator, is entitled to a maximum of 30% of the entire recovery from the whistleblower/qui tam defendant(s)—the specific percentage will be negotiated with the federal or state government involved in the lawsuit.

*The Burk Law Firm takes its percentage of any and all recoveries out of the Net Recoveries from the defendant(s). “Net Recovery” means the Gross Recovery minus The BLF’s expenses accrued over the duration of the lawsuit. (MGB: Please edit this!)

The BLF Does Extensive Investigation and Research to Prepare the Case to Present to the Federal or State Government to Induce Their Critical Involvement in the Lawsuit

We understand the importance of thorough work to present the case to the federal DOJ or the state attorney general to induce them to intervene and get involved in the lawsuit as this assures the best chance of success for the Client. BLF may try the case alone or in conjunction with the DOJ at the federal level or with the attorney general at the state level. This strategic focus not only positions your case for government intervention to enhance discovery and the chances of trial success but also enhances the likelihood of favorable and speedier pretrial settlements.
